Regarding a charitable donation

The terms of this Offering are binding on all persons making charitable donations via the Fund’s website.

1.General Terms

This Public Offering (hereinafter referred to as the ‘Offering’) constitutes an official and public invitation by the Charitable Organization «CHARITY FUND «TABOR» (hereinafter referred to as the Fund) to an indefinite group of individuals and legal entities to make a voluntary charitable donation in support of the Fund’s statutory activities.

The Offering is published on the Fund’s official website: bf-favor.org

The Offering is public in accordance with Articles 633, 641 and 642 of the Civil Code of Ukraine.

2.Subject matter of the Offering

The subject of this Offering is the voluntary and gratuitous transfer by the Donor of funds to the ownership of the Fund by making a charitable donation to enable the Fund to provide charitable support in accordance with the Law of Ukraine ‘On Charitable Activities and Charitable Organisations’, the Fund’s Charter, its charitable programmes, and so on.

A charitable donation does not constitute payment for goods or services.

3.The purpose of charitable donations

Charitable donations are used to carry out the Fund’s charitable activities, in particular to provide assistance to vulnerable groups.

The Fund is entitled to use a part of charitable donations for administrative expenses within the limits provided for by Ukrainian law.

4.Procedure of making a charitable donation

A charitable donation may be made by a Donor via:

  • funds transferred through payment systems;
  • bank transfer;
  • payment services available on the Fund’s website;
  • other methods not prohibited by Ukrainian law.

To accept charitable contributions, the Fund may use payment services and electronic payment systems, including Portmone.

Payment data is processed in accordance with the rules, terms and security standards of the relevant payment provider.

The Fund does not receive or store the full details of Donors’ payment cards.

5.Acceptance of the Offering

The acceptance of this Offering shall be considered to be any action taken by the Donor with the aim of making a charitable donation, in particular:

  • clicking the ‘Help’, ‘Contribute’ or ‘Donate’ button, or any similar button;
  • making a payment;
  • transferring funds to the Fund’s account.

From the moment of acceptance, the Offering shall be deemed to have been accepted by the Donor in full.

6.The voluntariness of charitable donations

The donor determines the following independently:

  • the amount of the charitable donation;
  • the frequency of donations;
  • the purpose of the charitable donation, specifically whether it is to support a specific project or fundraising campaign—provided there is a relevant announcement regarding the fundraising campaign on the Fund’s website or official information channels—or for the Fund’s statutory activities.

Making a charitable donation is voluntary and altruistic.

7.Refunds of charitable donations

A charitable donation is a voluntary contribution and is non-refundable, except in cases expressly provided for by Ukrainian law or in the event of a technical error during the payment process.

In the event of an erroneous or incorrect payment, the Donor may contact the Fund using the contact details provided on the Fund’s official website.

8.Fundraising period

The public fundraising of charitable donations shall continue until the Fund ceases its activities, including through its liquidation, unless a different timeframe for fundraising is determined by a decision of the Fund.

9.Personal data

By making a charitable donation, the Donor confirms that they have read and agree to the Fund’s Privacy Policy.

The Donor consents to the processing of their personal data to the extent necessary for the purposes of charitable activities, payment processing, communication, and compliance with the requirements of Ukrainian law.

10.Liability of the Parties

The Fund accepts no liability for:

  • technical faults in the operation of payment systems, banks or the internet;
  • temporary unavailability of the website;
  • errors made by the Donor when making a payment;
  • actions of third parties over which the Fund has no control.

The Donor is responsible for the accuracy of the information provided.

11.The Funds reporting

The Fund ensures the openness and transparency of its charitable activities and regularly publishes information on the implementation of charitable programmes, the use of charitable donations and the help provided.

Reports on the Fund’s activities, completed projects and the use of charitable contributions are published on the Fund’s official website and/or on the Fund’s official social media pages.

By making a charitable donation, the Donor agrees that information regarding the implementation of charitable programmes may be disclosed by the Fund in its reporting materials without disclosing the Donor’s personal data, unless otherwise provided for by Ukrainian law or a separate agreement between the parties.

12.Validity of the Offering

This Offering shall take effect from the moment it is published on the Fund’s website and shall remain in force indefinitely until it is withdrawn or updated by the Fund.

13.Amendments to the Offering

The Fund reserves the right to amend or supplement the terms of this Offering at any time without prior notice to Donors.

All amendments and supplements to the Offering shall be published on the Fund’s official website and shall come into effect upon publication, unless otherwise specified by the Fund.

Continued use of the Fund’s website and/or the making of a charitable donation following the publication of changes shall be deemed to constitute the Donor’s acknowledgement and acceptance of such changes.

14.Other Terms

In the case of any disputes between the Fund and the Donor, such disputes shall be resolved in accordance with the applicable laws of Ukraine in the competent court for the Fund’s registered office.
